Taylor | Foley: Probate

Probate is the legal process whereby the property (i.e. the “estate”) of a deceased person is marshaled by the Personal Representative of the estate and ultimately distributed to heirs and devisees after resolution of all claims against the estate.  Probate is generally completed under the jurisdiction of the probate court of the county in which the decedent resided at the time of their death.

Taylor | Foley attorneys have assisted numerous Personal Representatives in the administration of complex estates with assets valued in excess of $10 million.  The probate process can be confusing and time consuming for family members of the deceased and is made more difficult because it begins at a time when the deceased’s friends and family are still mourning their passing.  Taylor | Foley can take the burden of probate off of the deceased’s loved ones by handling the large and small details of the probate process.

As with all other matters handled by Taylor | Foley, particular attention will be given to tax planning strategies that enable the estate to minimize its transfer tax and income tax obligations.  Many of these tax planning strategies can also be addressed prior to death via a well-drafted estate planning package.
